1. Acceptance of Terms
By accessing or using the Cloud-PVE platform, you agree to be bound by these Terms of Use. If you do not accept these terms in their entirety, you must not access or use the service. These terms apply to all users, including individuals and legal entities.
2. Description of Service
Cloud-PVE provides managed Proxmox VE infrastructure as a cloud service operated by LenoIT SARL, France. The platform is accessible via a web interface and a REST API. Features and resource allocations vary by subscription plan.
3. Account Responsibilities
You are solely responsible for maintaining the confidentiality of your account credentials (username, password, and API keys). You must notify us immediately at contact@cloud-pve.com if you become aware of any unauthorised access to or use of your account. LenoIT shall not be liable for any loss arising from unauthorised use of your credentials.
4. Permitted Use
Cloud-PVE may be used for lawful commercial and personal purposes, strictly in accordance with your active subscription plan.
- Use of the service is limited to the resources and features included in your plan.
- Resale or subletting of Cloud-PVE resources to third parties is not permitted without a prior written agreement with LenoIT.
- You remain responsible for all workloads, virtual machines, and data hosted within your environment.
5. Prohibited Activities
The following activities are strictly prohibited on the Cloud-PVE platform:
- Any activity that violates applicable local, national, or international law or regulation
- Interference with, disruption of, or unauthorised access to other clients' infrastructure or data
- Attempting to probe, scan, or test the vulnerability of the platform or any connected system without authorisation
- Distributing, hosting, or transmitting malware, ransomware, or any malicious code
- Using the platform for spam, phishing, or unsolicited mass communications
- Violating the terms of the Proxmox VE end-user licence agreement
Violation of these prohibitions may result in immediate account suspension and legal action.
6. Service Availability
LenoIT targets a 99.9% monthly uptime for the Cloud-PVE platform, excluding scheduled maintenance. Planned maintenance windows will be communicated to users at least 48 hours in advance via email or the platform dashboard. Emergency maintenance may be carried out without advance notice where required to protect platform security or integrity.
7. Intellectual Property
The Cloud-PVE platform, its branding, interface design, and documentation are the exclusive intellectual property of LenoIT SARL. No licence to use LenoIT's intellectual property is granted except as strictly necessary to use the service.

8. Limitation of Liability
To the maximum extent permitted by applicable law, LenoIT's total cumulative liability arising out of or related to these Terms of Use shall not exceed the total amount paid by you in the three (3) months preceding the event giving rise to the claim.
LenoIT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or business interruption, even if advised of the possibility of such damages.
9. Termination
Either party may terminate the service agreement in accordance with the Terms of Sale. LenoIT reserves the right to suspend or terminate your account with 30 days' written notice for breach of these Terms of Use. In cases of serious violations, including but not limited to illegal activity, security breaches, or distribution of malware, LenoIT may terminate the account immediately and without prior notice.
10. Governing Law and Jurisdiction
These Terms of Use are governed by and construed in accordance with French law. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts of France.
